How do I make an enduring power of attorney?

An enduring power of attorney is a legal document. The process for making an enduring power of attorney includes a number of steps. If you decide to make one, it must be made, using our application form. You will need to have a number of different statements and supporting documents completed as part of the application. You will need to submit the application to us. You can make and submit your application through our online portal MyDSS.

We will review your application to ensure the enduring power of attorney meets the legal requirements. If it does, we will register it and add it to our Register of Decision Support Arrangements (also known as the Register).

The purpose of the Register is to allow approved professionals, approved organisations, and other persons to access your enduring power of attorney and the authority of your attorney, if they need that information. You and your attorney will also be able to access or download a copy of the registered enduring power of attorney through your MyDSS account.

Can someone help me to make an enduring power of attorney?

If you need help to make your application, the person you are appointing as your attorney or someone else, for example, a family member, friend or legal professional, can help you to do this. However, the online application can only be made through your (the donor’s) verified MyDSS account.

If you want your proposed attorney or someone else to communicate with us on your behalf when making your application, you will have to confirm this to us in writing.
