I want to make an objection

What is an objection?

An objection is the action of challenging or formally disagreeing with an aspect of a decision support arrangement.

It is possible for a person to object to, or disagree with, the registration of a decision support arrangement. However, objections can only be made in limited circumstances for specific reasons.

Specific criteria need to be met in order to make an objection:

  • A person's involvement in the arrangement and relationship to the people making it
  • the reason for the objection
  • the timeframe in which the objection must be made

What can I object about?

A person can object to the Decision Support Service about:

  • the registration of a co-decision-making agreement
  • the variation of a co-decision-making agreement
  • the registration of enduring power of attorney by the person making it
  • the notification of an enduring power of attorney by the attorney (to bring it into effect)

A person cannot make an objection to the Decision Support Service about:

  • a decision-making assistance agreement
  • a decision-making representation order
  • an advance healthcare directive

How do I make an objection?

The easiest way to make an objection to the registration or notification of an EPA is through our online portal, MyDSS. In the portal, you can use a specific form on which you can make your objection.

If you currently do not have a MyDSS account, you can create a basic account at the link MyDSS. You just need an email address to do so.

If you cannot access a computer or set up an account online, that is not a problem. You can get in touch, and we will help you set up your account or find an option that meets your needs.

⚠ You must make your objection within five weeks from the date notice was given. To calculate the five-week objection period, use the following example:  if the relevant person gives notice to you on Monday, 3 November, the five-week period for making an objection ends at midnight on Sunday, 7 December.

Note: We cannot accept objections that are made after the five-week deadline.
